These Terms and Conditions ("Terms") govern your use of the website and services provided by Performance Creates Separation LLC ("PCS," "we," "us," or "our"). By accessing our website, engaging our services, or communicating with us or our contractor clients by phone or SMS, you agree to be bound by these Terms. If you do not agree, please do not use our services.
Performance Creates Separation LLC provides automated call reception, lead capture, and communication services to home service contractors, including but not limited to roofing, HVAC, plumbing, electrical, landscaping, pool service, pest control, and general contracting businesses.
Our services include answering inbound calls on behalf of contractor clients, capturing caller information, filtering unwanted or spam calls, and delivering organized lead data to the contractor.
Program Description: Performance Creates Separation LLC sends transactional SMS messages on behalf of its contractor clients to individuals who have contacted those contractors requesting service. Messages include service request confirmations, callback notifications, and appointment scheduling updates.
Message Frequency: Message frequency varies based on your interactions with the contractor. You may receive up to 3 messages per service request.
Message and Data Rates: Message and data rates may apply. Standard carrier charges from your mobile provider will apply to all messages sent and received.
Opt-Out Instructions: You may opt out of receiving SMS messages at any time by replying STOP to any message you receive. Upon opting out, you will receive a single confirmation message and will not receive further SMS messages from that program.

Carrier Liability: Wireless carriers are not liable for delayed or undelivered messages.
Supported Carriers: Our SMS program supports major U.S. carriers including AT&T, Verizon Wireless, T-Mobile, Sprint, U.S. Cellular, and others. Carrier participation may change without notice.
Privacy: We do not sell, rent, or share your mobile phone number or SMS consent with third parties for marketing purposes. See our Privacy Policy for full details on how we handle your information.
Our services are offered on a monthly subscription basis. Plan pricing, features, and setup fees are described on our website and confirmed in writing prior to the start of service.
Clients may cancel their subscription at any time with 30 days written notice to alex@createseparation.app. Service will continue through the end of the current billing period.
We reserve the right to suspend or terminate service immediately in the event of non-payment, misuse of our services, violation of these Terms, or any activity that violates applicable law or carrier regulations.

We strive to maintain continuous service availability. However, we do not guarantee uninterrupted access. Services may be temporarily unavailable due to maintenance, third-party provider outages, or circumstances beyond our reasonable control.
We are not liable for missed calls, undelivered messages, or lost business resulting from service interruptions, carrier failures, or third-party platform outages.
All content on this website, including text, graphics, logos, and software, is the property of Performance Creates Separation LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
To the fullest extent permitted by law, Performance Creates Separation LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to lost profits, lost business opportunities, or loss of data.
Our total liability for any claim arising from these Terms or our services shall not exceed the total amount paid by you to us in the three months preceding the claim.
Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
You agree to indemnify and hold harmless Performance Creates Separation LLC, its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, your violation of these Terms, or your violation of any applicable law or third-party right.
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Charlotte County, Florida.
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Your continued use of our website or services after any changes constitutes acceptance of the updated Terms.
